Terms of service

Last updated: 24 October 2026

These Terms govern purchases of physical products from shop.sixfab.com. Your seller is Sixfab, Inc., a Texas corporation, at 825 Watter’s Creek Blvd., Suite 250, Allen, Texas 75013, United States ("Sixfab", "we" or "us"). We sell to individuals and businesses. Company information is available in our Company & Contact Information.

I. Definitions and Scope

"Products" means the physical goods specified in your order, including hardware, accessories and physical SIM cards. "Order" means your purchase of those goods. A consumer purchases mainly outside their trade or profession; a business customer purchases for business purposes, subject to applicable law.

Purchasing a physical SIM card does not purchase activation, a data allowance, software subscriptions or connectivity services. Those services, including services sold by Sixfab, Inc. through other channels, require their own service order and applicable service terms. These store Terms do not govern those services. Embedded firmware and any separately identified software licences accompanying hardware remain subject to the relevant product specifications and licences.

Custom design, development and integration projects are governed by their separately agreed project terms. An order for a physical custom product through this store remains subject to these Terms except where specific terms have been expressly agreed.

II. Order Placement, Cancellation and Acceptance

Review the products, quantities, delivery details, prices and charges before submitting your order. You may correct errors before completing checkout. Submitting an order is your offer to buy the specified goods.

An automatic order acknowledgement records receipt of your order. We accept the order when we have accepted payment and confirm shipment. We may decline an order before acceptance for a genuine availability, payment, fraud-prevention or legal-compliance reason. If we cannot supply goods for which we have collected payment, we notify you and refund the payment due for those goods. We do not retain payment for goods we cancel and do not supply.

Payment is normally collected at checkout. A payment authorisation alone is different from capture of funds. Keep the order and shipment confirmations for your records. The contract language is English.

Change-of-mind returns are governed by the Return & Refund Policy. Contact us promptly if you need to change or cancel an order; we may be unable to stop fulfilment once processing has begun. This does not restrict a cancellation or refund right required by law, including rights arising from a shipment delay.

Accepted orders are subject to the terms agreed for that order. We do not retrospectively change their price or terms through a later website update. An obvious pricing error or inability to perform is handled under applicable law, with notice and repayment where required.

III. Prices, Payments and Taxes

Our base currency is US dollars (USD). Where local-currency checkout is offered, the currency and final amount collected by us appear before purchase. Your bank or payment provider may impose its own currency-conversion or cross-border charges. The available payment methods, including Shopify Payments and PayPal where offered, appear at checkout.

Applicable US sales tax and shipping charges are calculated and displayed before payment. A business purchase is not automatically tax-exempt; any applicable exemption must be supported by valid documentation and accepted under the relevant tax rules.

For international orders, the recipient is responsible for import clearance, import duties, import taxes and carrier clearance charges under the Shipping Policy, except for any tax we are legally required to collect or expressly collect at checkout. We do not offer prepaid import duties under our standard shipping arrangement. Our allocation of import charges does not transfer a seller tax obligation to the customer.

You must be authorised to use the payment method you provide and pay amounts properly due. Do not submit knowingly false payment disputes. Legitimate chargebacks, payment disputes, refunds and other statutory rights remain available. If payment fails or is reversed while the price remains legally due, we may hold the affected shipment and contact you to resolve the issue. Any cancellation or recovery of fees must have a lawful basis; a dispute does not automatically cancel unrelated paid orders.

IV. Obligations of the Parties

Sixfab’s obligations

We supply the goods described in the order, with their stated components, compatibility and specifications, and comply with our applicable product and seller obligations. Product documentation describes the intended use and relevant limitations. The Limited Warranty in section VIII and mandatory legal rights govern product defects.

Customer information and account security

Provide accurate order, contact, billing and delivery details. If purchasing for a company or another person, you must have authority to act for them. Keep account credentials secure, restrict access to authorised users and promptly report suspected compromise. Account access alone does not make you liable for every unauthorised transaction regardless of applicable law.

Provide destination, end-user or other information reasonably needed to complete the order or comply with law. We will explain missing information and any resulting delay. We may take proportionate protective action where there are reasonable grounds to suspect fraud, security compromise or misuse, while preserving lawful support and refund routes.

Product integration and intended use

Products may be used for development and commercial integration in accordance with their specifications, instructions and applicable law. Buying a component or development kit does not mean that Sixfab has approved the complete system you design or assemble.

You are responsible for your system architecture, third-party components, installation, configuration, integration and appropriate validation. Consider power, interfaces, antennas, thermal and environmental conditions, firmware, software compatibility, security and failure behaviour. Do not use products beyond documented limits.

Before deploying or supplying the resulting system, perform the assessments, tests, approvals and instructions required in your role as designer, integrator, manufacturer or supplier. A component approval does not automatically certify a complete or modified system. Reference designs and examples assist development and do not replace system validation.

Where failure could cause injury, environmental harm or serious property damage, implement appropriate independent safeguards and assess whether the documented product is suitable. You are responsible, as determined by applicable law, for loss caused by your improper integration or use. This does not transfer Sixfab’s own product-compliance duties, exclude responsibility for defects in our products, or invalidate a claim for an unrelated defect merely because a product was integrated or modified.

V. Intellectual Property Rights

Rights in product designs, firmware, software, documentation and trademarks remain with Sixfab or the relevant rights holders. Ownership of a physical product is separate from ownership of those rights.

You may use purchased hardware for its intended purpose and lawful commercial integration. Purchasing hardware does not itself authorise manufacturing copies of protected designs, distributing protected software or documentation beyond its licence, or branding your products with Sixfab trademarks or implying endorsement. Lawful resale and identification of genuine goods remain subject to applicable law.

Separately identified software, documentation and open-source licences govern the materials they cover. These Terms do not reduce rights granted by those licences or by mandatory law, including applicable interoperability and reverse-engineering rights. Hardware use is not made dependent on maintaining a data or software subscription by these Terms.

VI. Limitation of Liability

The responsibilities for customer system design and integration are set out in section IV. They do not excuse a breach of Sixfab’s own obligations. Liability is determined under applicable law. Nothing in these Terms excludes liability that cannot lawfully be excluded, including mandatory product liability or responsibility for death or personal injury where applicable law prohibits its exclusion.

VII. Communications and Privacy

We send necessary order, payment, delivery, support and legal communications using the contact details you provide. Optional marketing is managed separately; accepting these Terms does not itself give consent to optional tracking or marketing.

Our Privacy Policy describes store data processing, Shopify Enhanced Services, payment providers, group support and privacy choices. Separate Sixfab services have their own applicable notices and terms.

VIII. Sixfab Limited Product Warranty

The additional limited warranty below applies to purchases for supply outside Australia. For purchases for supply in Australia, only the statutory consumer guarantees and remedies described under “Australian purchases” below apply; we do not offer this additional 180/30/90-day defects warranty for those purchases. This distinction applies prospectively and does not withdraw a warranty already given for an earlier purchase.

Warrantor, coverage and period

The warrantor is Sixfab, Inc., 825 Watter’s Creek Blvd., Suite 250, Allen, Texas 75013, United States; email legal@sixfab.com; claims and support through our contact form.

For genuine products purchased from Sixfab or an authorised Sixfab distributor, we provide the following limited warranty from delivery by Sixfab or that distributor:

Product Limited warranty period and coverage
IoT hardware 180 days: conformity with the published product specifications.
Physical cellular SIM cards 30 days: conformity with the published card specifications. This does not warrant a separately supplied data service under the hardware order.
Custom-designed cellular development kits, if supplied 90 days: freedom from defects in materials and workmanship, subject to any separately agreed project warranty.

Exclusions

This limited warranty does not cover a problem caused by neglect, misuse, improper storage, installation or testing, operation outside documented limits, customer system design or customer-provided specifications. Modification or third-party work is excluded only to the extent it causes the claimed problem; it does not automatically remove coverage for unrelated defects. Counterfeit products are not covered by this Sixfab warranty.

We do not warrant suitability for an undisclosed special purpose merely because we provide general examples or support. This does not override an agreed specification, an express product promise or any applicable implied warranty. Non-payment does not erase mandatory defect rights.

Making a claim and obtaining a remedy

Contact us during the applicable warranty period with your order or purchase evidence, product details and a description of the problem. We may reasonably request photographs, diagnostic information or troubleshooting to assess the claim. We provide return instructions and a return reference where needed. The designated facility is Sixfab, Inc. / ShipMonk, 2601 NorthEast 33rd Street, Fort Worth, TX 76111, United States. Our Allen address remains the address for legal correspondence.

For a verified defective or incorrectly supplied product, Sixfab pays for the return label, including an international return under this programme. Contact us to arrange the label before dispatch. If we agree that you should arrange return transport, keep the receipt and submit it through the contact form for reimbursement of the agreed reasonable cost. Mandatory reimbursement rights remain unaffected.

For an approved repair or replacement, Sixfab pays the shipping cost of sending the repaired or replacement product to an address in the United States. The customer pays that outbound shipping cost to an address outside the United States; we explain the charge and obtain agreement before dispatch. This allocation does not make you responsible for a cost that applicable law requires Sixfab to bear, including any necessary transport cost of a mandatory statutory remedy.

For a covered failure, Sixfab will, at its option and subject to mandatory rights, repair or replace the product or provide a credit. A credit does not replace a cash refund or other remedy that the law requires, and store credit in place of a legally required refund requires your agreement. Assessment and the remedy will be completed within a reasonable time. Products repaired under this warranty retain the remainder of the original warranty; replacement products receive a new full applicable limited warranty period from their delivery.

The 7-day prompt-reporting request and the separate 30-day return programmes in the Return & Refund Policy do not shorten this warranty. A claim notified within the warranty period is not lost solely because authorised return transport finishes later. Mandatory rights may apply beyond these commercial periods.

Statutory and implied warranties

THIS IS A LIMITED WARRANTY. IT IS ADDITIONAL TO RIGHTS AND REMEDIES THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW. WE DO NOT DISCLAIM IMPLIED WARRANTIES ON A CONSUMER PRODUCT WHERE OUR WRITTEN WARRANTY OR APPLICABLE LAW PREVENTS THAT DISCLAIMER. These Terms do not impose a separate contractual reduction of the duration of those implied warranties.

This warranty gives you specific legal rights, and you may also have other rights which vary from state to state or country to country. No exclusion above applies to the extent prohibited by applicable law.

Australian purchases

For purchases for supply in Australia, we rely on the rights and remedies provided by applicable law, including the Australian Consumer Law where it applies, rather than offering the additional defects warranty above. The 180/30/90-day periods, commercial remedy choices and commercial exclusions above do not limit those statutory rights.

Where the Australian Consumer Law applies, goods must meet the applicable consumer guarantees, including acceptable quality, correspondence with their description and suitability for a purpose covered by the law. The nature of a failure determines the available remedy. For a major failure, you may have the choice of rejecting the goods for a refund or replacement and may claim reasonably foreseeable loss. For a remediable failure that is not major, we must provide the legally required remedy within a reasonable time; further remedies may arise if we do not. The reasonable duration of these rights depends on the goods and circumstances and is not restricted to the commercial warranty periods listed above.

Report a problem through our contact form or legal@sixfab.com with purchase details and a description of the issue. We assess and handle the claim under applicable law and bear transport or other remedy costs that the law requires us to bear. Contact us before arranging return transport so that we can provide the appropriate instructions. The separate unopened-product change-of-mind return programme remains available on its stated terms and does not replace these statutory rights.

IX. Returns and Refunds

Our Return & Refund Policy governs the 30-day unopened-product return programme, the separate prompt-resolution programme for missing, damaged, faulty, wrong or incomplete goods where offered, and return handling. The limited warranty, where offered, and mandatory rights continue separately. Australian purchases follow the statutory defect-remedy arrangement explained above and in that policy.

X. Shipping and Export Controls

Orders ship from our US fulfilment facility through ShipMonk. Destinations, carrier options, preparation times, shipping charges, import obligations and transit risk are explained in our Shipping Policy. Special quote-based orders or customer carrier arrangements may have expressly agreed delivery terms.

Orders and any onward export, re-export or transfer must comply with applicable US export controls and sanctions and other laws applicable to the relevant item or transaction. Requirements depend on product classification, destination, end-user and end-use. These Terms do not assign a single export classification to all products or describe every excluded shipping country as comprehensively sanctioned.

Do not divert or supply products to prohibited persons, destinations or end-uses, or without a required authorisation. Do not circumvent restrictions through intermediaries. Restrictions may concern military end-users or end-uses, weapons proliferation, or other controlled uses where the relevant rules apply. Provide accurate compliance information reasonably requested by us. Each party remains responsible for its own legally required screening, classifications, licences and records. Communicate applicable onward-transfer restrictions to subsequent recipients where required.

We may hold or decline a shipment that cannot lawfully proceed. Any cancellation, notice and refund will be handled under applicable law. We do not retain payment merely because an unsupplied order is cancelled for compliance reasons.

XI. Use of the Store

Do not impersonate others, submit fraudulent orders, introduce malicious code, interfere with the store or seek unauthorised access to systems or personal information. Protective account restrictions must be proportionate to the suspected misuse and do not automatically remove rights relating to existing orders. Contact us for review of an account issue or to access support while an account is restricted.

XII. Other Provisions

Governing law and disputes

The laws of the State of California, United States, govern these Terms, excluding conflict-of-laws rules and the United Nations Convention on Contracts for the International Sale of Goods. Subject to mandatory jurisdiction rules, the parties submit to the competent courts in California. For consumers, this choice does not remove mandatory protections or a right to bring proceedings in another court where applicable law preserves that right. No mandatory arbitration or class-action waiver is created by these Terms.

Notices and applicable version

For customer support, use our contact form. Send legal notices to legal@sixfab.com or the Allen address above. The version applicable when your order is accepted governs that order; later revisions apply prospectively. Expressly agreed order terms take precedence to the extent permitted by law. If a provision is ineffective, applicable law governs that issue and the remainder continues to the extent permitted.
